1. Scope The ananné products available in our e-Boutique are exclusively intended for end users.

These General Terms and Conditions shall apply to the dispatch of goods to or within the European Union. The published version of these General Terms and Conditions in force at the time the contract is concluded shall apply to all commercial transactions between ananné and yourself that entail the acquisition of ananné products.

These General Terms and Conditions shall apply exclusively. Any terms and conditions set by the customer that deviate from or supplement these Terms and Conditions shall not be recognised by ananné. Such terms shall not form a part of the contract, even if ananné does not expressly deny recognition.



2. Creation of contract The presentation of goods in our e-Boutique does not represent any binding offer from ananné to conclude a purchase contract. You may select products from our range and collect them in the “basket” by clicking on the button “Add to basket”. At any time before submitting your order you may view, change or delete the data saved there.

Before registering or submitting your address details, you make a binding offer to buy the goods in the basket by clicking on “Go to checkout”. The order can only be submitted if you have accepted these terms and conditions of the contract. By accepting these terms and conditions, you apply them to your order. The General Terms and Conditions may be read, printed out or saved onto a local computer at any time via your internet browser.

A contract is created once payment has been made and ananné accepts the contractual offer issued through your order by an immediate e-mail labelled as a confirmation of the order (e-mail subject line: “Thank you for your order”).



3. Delivery ananné shall dispatch deliveries to the delivery address within the European Union that you specify. Deliveries shall be made by parcel courier service, post or freight forwarder. Goods shall be transferred to the parcel courier, postal operator or freight forwarder no later than 5 working days after our order confirmation is issued to you. Delivery time may be up to 14 days. ananné is entitled to make use of split deliveries at no extra charge to you.

In the event that you are not present at the time of the delivery, the relevant distributor’s terms and conditions shall apply. In the event that you refuse to accept the delivery, you shall be responsible for any additional costs arising as a result.



4. Prices and delivery costs The published prices are total prices and are inclusive of the applicable VAT.

Shipment is subject to the cost displayed at purchase. The share customers are billed for are as follows:
purchase value up to 50 Euro: 18 Euro shipment and delivery cost
purchase value up to 100 Euro: 9 Euro shipment and delivery cost
purchase value up to 200 Euro: 5 Euro shipment and delivery cost
If the purchase value exceeds 200 Euro, ananné covers all costs for shipment and delivery.



5. Payment You may pay for your purchases using any of the following electronic payment methods: American Express, Mastercard, Visa. In the event that a refund is issued by ananné, you will immediately receive an electronic voucher for the relevant amount. No cash refunds will be given.



6. Right of revocation Advice on revocation
You may revoke your contractual acceptance without giving reasons within two weeks either in writing (e.g. by letter, fax or e-mail) or – if the goods reach you within this two-week period – by returning the goods.

The two-week period shall begin upon receipt of this advice in writing, but not before receipt of the goods and not before our legal information obligations have been met. The deadline for revocation shall be deemed met provided that the notice of revocation or the item has been sent in due time. Notice of revocation should be addressed to:

Effects of revocation
In the event that an order is duly revoked, both parties shall return any items or payments they have received together with any benefits from usage (e.g. interest). If you cannot return the item or a part thereof, or if it has been used or damaged, you must replace the value of the item to the extent necessary. This can mean that you must fulfil the contractual obligations regarding payment for the period up until revocation. This shall not apply in cases where damage to an item is solely a result of its inspection, such as would be possible in a shop. You can also avoid the obligation to replace the value of an item where it has been damaged as a result of utilisation as instructed, by not using it as if it were your own and refraining from any action that may decrease its value.

Items that can be sent as a parcel should be returned at our risk. You will bear the cost of returning the item. Items that cannot be returned as a parcel shall be collected from you. Obligations to return payments received must be fulfilled within 30 days. This deadline period shall begin for you upon dispatch of the notice of revocation or the item, and for us upon receipt of either of these.



7. Warranty ananné attaches great importance to your satisfaction. We make every effort to exercise due care when processing your order. Warranty in the event of a defect shall be governed by the statutory provisions. ananné neither issues nor accepts any guarantees. The time limit for customer warranty claims shall be 2 years. Customer claims for damages shall be subject to the following regulations in Section 8 of these General Terms and Conditions.



8. Liability ananné shall be liable without limitation to the extent that the damage is a result of a deliberate act or gross negligence and for death, bodily injury and damage to health. Furthermore, ananné shall be liable in the event of a negligent breach of material obligations where the breach jeopardises achievement of the purpose of the contract, and in cases of a breach of obligations, where the fulfilment of these obligations is necessary in order for the contract to be duly performed at all and where compliance with such obligations is constantly relied upon by you. However, in such cases ananné shall only be liable for foreseeable damage which is typical for this type of contract. Finally, ananné shall also be liable for a defect under any accepted guarantee for product quality or shelf life and in cases of defects actively concealed. Liability under the Product Liability Act shall not be affected.

ananné shall not be liable for breaches of any obligations other than those mentioned in the paragraph above. The extent to which the liability of ananné is excluded or limited shall also apply to the liability of employees, representatives and agents of ananné.



9. Data protection ananné will record your personal data for the purposes of processing the order and would like to make shopping as easy as possible for returning customers.

We will treat your details as confidential and shall comply with the current legal provisions regarding data protection. For the purposes of your order, we will save and process all data entered in this connection (such as name, delivery address, e-mail address, telephone number, credit card details, user account details, product preferences, survey data, etc.) in accordance with the relevant provisions of the Federal Data Protection Act (“Bundesdatenschutzgesetz”) and the Telemedia Act (“Telemediengesetz”). The only customer data that will be passed on to third parties will be that deemed necessary for the processing of the order (e.g. for delivery, payment by credit card).

You have the right to receive information free of charge at any time as to whether and which data relating to you is being processed. You may at any time arrange for incorrect data to be rectified or for your data to be deleted.

10. Saved records of contract wording We will not save the contract wording and it cannot be retrieved once the ordering process has been completed. You can print out the order data immediately after the order has been submitted.



11. Applicable law/severability clause Contracts concluded with ananné shall be subject to German law. The sole place of jurisdiction is Munich, Germany. ananné is also entitled to institute claims proceedings in the customer’s residence or usual domicile.

The legal ineffectiveness of individual provisions of these General Terms and Conditions shall not affect the validity of the contract or of the remaining provisions of these General Terms and Conditions.
